WHAT IS THE MICHIGAN SUPER DRUNK LAW?

Any person arrested for suspected drunk driving whose breath or blood test reveals a bodily alcohol content (BAC) of .17 or higher is subject to the Michigan High BAC Super Drunk Law.

Compared to a Michigan OWI / DUI drunk driving first offense, the penalties for operating a motor vehicle with a high BAC and charged under the Michigan Super Drunk Law are significantly more punitive. This is true even in the case of a first offense.

MICHIGAN SUPER DRUNK LAW PENALTIES

Drivers convicted of a High BAC Michigan Super Drunk Law offense face the following penalties:

•Up to 180 days in jail
•Up to a $700 fine
•Up to 360 hours of community service
•A one-year license suspension
•One-year treatment program

LICENSING SANCTIONS

For many facing a charge under the Michigan Super Drunk Law, the most significant consequence of a conviction is the potential licensing sanction.

All high-BAC offenders face suspension of driving privileges for one year, with the first 45 days being a “hard” suspension—no driving allowed.

For the remaining 320 days, the offender may be allowed restricted privileges if they have a breath alcohol ignition interlock device (BAIID) installed in the car they drive during this time period. There is a monthly maintenance cost for the BAIID in addition to the installation cost, and the convicted driver is responsible for that cost as well. In Michigan, the cost of maintaining a BAIID can vary but run as high as several hundred dollars per month. If the driver meets certain low-income requirements, there may be cost adjustments made.
